Transfer of Film Copies to the Swiss Film Archive

Information for Swiss Holders of Rights

The SWISS FILMS Foundation and the Swiss Film Archive hereby inform you that all film copies that are the property of SWISS FILMS will be transferred to the Swiss Film Archive as of 1st January 2018. After the transfer of ownership, the film copies will be made available in accordance with the normal rules of use of the Swiss Film Archive (see below). The Swiss Film Archive will not, however, adopt the contracts that SWISS FILMS has concluded with the holders of rights of the film copies concerned.

Rules of Use of the Swiss Film Archive:

  • The Swiss Film Archive is entitled to make the archive material available to private individuals and institutions for personal use in accordance with Articles 19 and 20 of the Swiss Federal Copyright Law (URG). This also applies to schools, universities and universities of applied sciences for teaching and research purposes. The provision of the material is subject to the requirement that the users pay the remuneration due in accordance with the applicable rates of the collective management of the licensed collective rights management organisations.
  • If remuneration for the use of copyrights is due, this must be covered by the organiser. The Swiss Film Archive only pays remuneration for the films to which it has acquired the rights in individual cases.
  • The organiser must cover all handling fees and transport costs incurred.
  • In accordance with the regulations of the International Federation of Film Archives (FIAF), the Swiss Film Archive is authorised to use the copies for its own purposes, for its partner screening associations in Switzerland and in its exchanges with the members of the FIAF.
